This Privacy Policy describes how Inter Cars Italia S.r.l. a Socio Unico (“Inter Cars” or the “Company”) collects and processes the personal data of the users that visit the Company’s website as well as of the other data subjects that hold relationships with the Company for several respects specified below (Sections 2-5).

2. WEB SITE PRIVACY POLICY

This information is given to the users (individuals) of our website http://it.intercars.eu/ (the “Website”) and concerns the processing of their personal data in accordance with the modalities and purposes described as follows. This information is provided pursuant to Section 13 of The General Data Protection Regulation (GDPR) (EU) 2016/679 and it is drafted in compliance with the resolutions of the Italian Data Protection Authority and with the European authorities’ guidelines.
This information only applies to the Website and does not concern any other website that may be reached by the user via external links.

Data Provided Voluntarily by Users

Inter Cars may collect some personal data (name, surname, e-mail address, telephone number, postal address, etc.) that the users send by e-mail.

Netsurfing Data

The information systems and software procedures relied upon to operate this website acquire personal data as part of their standard functioning; the transmission of such data is an inherent feature of Internet communication protocols.
Such information is not collected in order to relate it to identified data subjects, however it might allow user identification per se after being processed and matched with data held by third parties.
This data category includes IP addresses and/or the domain names of the computers used by any user connecting with this web site, the URI (Uniform Resource Identifier) addresses of the requested resources, the time of such requests, the method used for submitting a given request to the server, returned file size, a numerical code relating to server response status (successfully performed, error, etc.), and other parameters related to the user's operating system and computer environment.
These data are only used to extract anonymous statistical information on website use as well as to check its functioning; they are erased immediately after being processed. The data might be used to establish liability in case computer crimes are committed against the website.

3. CUSTOMERS’ PRIVACY POLICY

Purpose and legal basis of the processing

Customers’ personal data will be used for institutional purposes, connected or instrumental to the activity of the Company, namely:

A. Management of the relationship: execution of the pre-contractual measures aimed at the sale and, eventually, of the services requested (for example: for logistic, accounting purposes), management of the relative contractual relationship and after-sales services, as well as fulfillment of obligations required by law;

B. Marketing: sending commercial and / or promotional communications by sending newsletters, by e-mail, faxes, e-mails, messaging services (eg via Facebook and Linkedin).

For the purposes referred to in paragraph A. (management of the relationship), the processing of personal data is necessary for the execution of the contract of which it is part or the execution of pre-contractual measures required, as well as to fulfill legal obligations.

For the purposes referred to in paragraph B. (marketing) above, personal data will be processed only in compliance with the consent given expressly and specifically.

The processing of data will be based on principles of correctness, lawfulness and transparency, to protect the customers’ rights and will take place through appropriate tools to ensure security and confidentiality. The processing will include the use of manual, computerized and telematic tools, with logic strictly related to the purposes indicated above.


Categories of data processed

The data processed will be exclusively identifying data (name, surname, address, postal code, telephone number, email address, shipping address ...) of the customer (if an individual), or the customer’s contact people (if it is a company).


Mandatory or optional nature of the provision of data, consequences of any refusal to respond

The conferment of these data is necessary for the pursuit of the purposes indicated above in point A, failure to provide them will make it impossible to establish and execute the contract of sale and provide the services requested.
Instead, the conferment of the aforesaid data for the pursuit of the purposes indicated above in point B being optional, failure to provide them will only make it impossible for the Company to send commercial and / or promotional communications.


Categories of subjects to whom personal data may be communicated or who may become aware of them

We inform that within the limits strictly relevant to the obligations, tasks or purposes indicated above, the data may be known by our agents and by third parties who perform on behalf of the Company ancillary activities such as: third-party companies that manage the sending of commercial communications and / o Promotional third-party online sales platforms and third-party service providers in general (for example, third-party companies that provide shipping, logistics, goods supply, banking, accounting and tax services).
All the aforementioned third parties are appointed by the Company in charge of processing the data pursuant to art. 28 of the Rules;

Except as specified in the previous paragraph, the data will be processed exclusively by employees and / or collaborators of the Company formally authorized for treatment pursuant to art. 29 of the Regulations, in compliance with the provisions of the law also with regard to security measures to protect and safeguard the aforementioned data.

Finally, the data may be transmitted to other Group companies, with offices in EU and non-EU countries, such as, for example, Bosnia, Moldova and Ukraine. Any non-EU transfer of such data will be made on the basis of standard EU approved contractual clauses which guarantee an adequate protection of personal data in accordance with the Regulation signed between the Company and the other Group companies.

Personal data will not be disseminated in any way.


Period of retention of personal data

The data processed for the purpose indicated in paragraph A will be kept for a period not exceeding that necessary to fulfill the obligations or tasks required by law, regulations or contracts in relation to the customer relationship.

The data will, however, be kept for a maximum period of 12 months for marketing purposes (paragraph B), subject to revocation of consent for these purposes.

4. CANDIDATES’ PRIVACY POLICY

Purpose and legal basis of the processing

The processing will be carried out using electronic and non-electronic means, exclusively for the purposes of search and selection of personnel.

The processing is based on the need for pre-contractual information in view of candidates’ possible recruitment and at their request and, as regards sensitive data, based on their consent.


Mandatory or optional nature of the provision of data, consequences of any refusal to respond

The conferment of these data is a necessary requirement for the process of research and selection of personnel and without them Inter Cars cannot take into account the candidacy.


Categories of subjects to whom personal data may be communicated or who may become aware of them

Candidate’s personal data will be accessible to employees and collaborators of the Company specifically authorized for processing and may be disclosed to third parties that the Company uses for research and selection of personnel, appointed as Processors pursuant to art. 28 of the Regulation. These data may also be transferred to other companies of the Inter Cars Group with offices in other EU and non-EU countries, such as Bosnia, Moldova and Ukraine. Any non-EU transfer of these data will be made on the basis of standard EU approved contractual clauses signed between the Company and the other Group companies.


Period of retention of personal data

Candidates’ data will be kept for the period necessary for selection and will be deleted at the end of the selection process, except in case of express and specific consent to participate in future selections - in which case the retention period of the data will be 12 months. In the event that Inter Cars should hire the candidate, the personal data will be kept for the length of time necessary for employment.

5. SUPPLIERS’ PRIVACY POLICY


Purpose and legal basis of the processing

The personal data will be used for institutional purposes, connected or instrumental to the activity of the Company, namely:

A. Management of the supplier relationship: execution of pre-contractual measures, execution of the contract / contracts to which the supplier is a party, as well as fulfillment of obligations established by law;

For the purposes referred to in paragraph A. Instead, failure to provide the aforesaid data for the pursuit of the purposes indicated above in point B., being optional, will only make it impossible for the Company to send to the supplier commercial and / or promotional communications.

6. RIGHTS

We perform the duty of information pursuant to art. 13 of the Regulation by informing the data subjects that they have the right to ask the Data Controller to access personal data, to know the origin, the logic and the methods of treatment, to obtain the updating and correction or (in the cases provided for by the Regulation) the cancellation, the limitation of the processing or to oppose the processing; they also have the right to receive such personal data in a structured format, commonly used and readable by automatic device and to transmit them to another processor without impediments. Finally, they have the right to withdraw their consent at any time without prejudice to the lawfulness of the treatment based on the consent given before the revocation, and the right to lodge a complaint with the Personal Data Protection Authority according to the law.
